S.A.M.C. Corp. v. Pawtucket Mutual Insurance Company
The owner of a small business was being sued by a former customer under the American's with Disabilities Act (A.D.A.), and was denied insurance coverage for the incident under his business owner's liability policy. In a case first to address the issue of whether or not a claim under the A.D.A. was an intentional or negligent act the U.S. District Court in the Southern District of New York agreed that claims made pursuant to the A.D.A. were more akin to negligence actions. As a result, the insurer was ordered to provide a defense and indemnify the business owner under the terms of his insurance policy.
